This Terms of Use Agreement is effective as of 01/07/2021.

SelfMaid Pvt Ltd ("SelfMaid") primarily operates controls and manages the Services (as defined below) provided by it from its corporate office at Sector 32, G-26, Gurugram, Haryana-122001 (“Gurugram Corporate Office”).


ACCEPTANCE OF TERMS

These terms and conditions cover the legal rights, obligations and responsibilities between you and SelfMaid, a company incorporated in India, operating from its Gurgaon Corporate Office, in respect of any services of selected third-party service providers (the "Professionals") offered for booking via our website www.SelfMaidpvtltd.com (the "Website") or a SelfMaid mobile application (the "App") including the classified advertisements, various email functions and Internet links, and all content and SelfMaid services available through the domain and sub- domains of SelfMaid and the online transactions between those users of the Website who are offering services (each, a "Service Professional") and those users of the Website who are obtaining services (each, a "Service User"). We refer to the Website and the App together as the "SelfMaid Platform".

Please read them carefully before you make a booking via the SelfMaid Platform, as they will apply to your booking. By raising a requirement and making a booking via the SelfMaid Platform, you confirm that you accept these terms and conditions and that you agree to comply with them. If there is anything you do not agree with, please do not make a booking/raise a requirement.

You further agree that you authorize the transfer of payment for Services requested through the use of the SelfMaid Platform and certify that you are either a Service Professional or a prospective Service User agreeing to be bound by all terms and conditions.

Further additional terms and conditions, disclaimers and other policies are also considered as terms and conditions. It is obligatory for you to visit this page periodically to review the terms of use because they are binding on you.

MODIFICATIONS TO TERMS OF USE AND/OR PRIVACY POLICY:-

It shall be the sole discretion of the Company to make any changes or amendment to these Booking Terms and Conditions from time to time. You should check these Booking Terms and Conditions each time you wish to make a booking via the Handy Platform, to make sure that you understand the terms which will apply at that time. Your use of the SelfMaid Platform following any amendment of the Terms and Conditions will signify your assent to and acceptance of any revised Terms and Conditions.

MEMBERSHIP AND ACCESSIBILITY:-

1. License To Access

Whilst SelfMaid grants you a non-exclusive, revocable license to use the Website, you will not copy or make derivative works of the SelfMaid Platform in any medium and you will not alter or modify any part of the SelfMaid Platform.

2. Membership Eligibility

You represent, acknowledge and agree that you are at least 18 years of age, and that: (a) all registration information that you submit is true and accurate, and (b) your use of the SelfMaid Platform and Services offered do not violate any applicable law or regulation.

You are solely responsible for safeguarding your SelfMaid password and, if applicable, your Third-Party Site Password (collectively, "Passwords") at all times and shall keep your Passwords secure at all times. You agree that you will not misrepresent yourself or represent yourself as another user of the Website and/or the Services offered through the Website. You hereby expressly acknowledge and agree that you yourself and not SelfMaid will be liable for your losses, damages etc. (whether direct or indirect) caused by unauthorized use of your Account.

You shall not use any automated system to access the SelfMaid Platform for any purpose. You shall not collect Service Professionals or Service Users information or otherwise misuse or misappropriate information or content. You shall not recruit, solicit, or contact in any form Service Professionals or Service Users for employment or contracting for a business not affiliated with SelfMaid without express written permission from SelfMaid.

You warrant that you shall not take any action that unreasonably encumbers the Platform’s infrastructure or interferes with the proper working of the SelfMaid Platform.


    SELFMAID’S WARRANTIES & REPRESENTATION:-

    SelfMaid’s Declarations

    Do not send us any confidential or proprietary information except for any personally identifiable information that we agree to keep confidential as provided in our Privacy Policy. We assume no obligation to protect confidential or proprietary information from disclosure and will be free to reproduce, use, and distribute the information to others without restriction. Also following are considered to be binding by/on the Customers:-

    • The Company focuses on providing the best of the Service Professionals. We expect every Customer to satisfy themselves from the services given by the Service Professional.
    • You may only make a booking if you are aged over the age of the legal majority in your jurisdiction. We may ask you to provide us with valid proof of identity in a form reasonably acceptable to us upon request.
    • All Services shown on the SelfMaid Platform are subject to availability and the images and/or descriptions of the Services on the SelfMaid Platform are for illustrative purposes only – actual Services may vary from those images and/or descriptions, but we ask our Professionals to ensure that they provide the Services in accordance with those descriptions.
    • SelfMaid has the sole discretion to stop the services of the customer, where the company finds the customer mishandling, misusing the services and not providing a healthy working/living environment to the service professionals.
    • The Customer agrees that the Company may take a little longer time than the expected one to assign the Service Professional as it takes time to allocate or assign Service Professionals for different Job Description.
    • We advise that you exercise caution to protect your personal safety and property while interacting with the Service Professional and keep checking the bags and belongings of the Service Professionals while they are coming and going out of your premises. SelfMaid shall not be held responsible for any kind of loss/ damages, theft incurs by any of the Service Professionals.
    • In the case where the service professional incurs any damage/loss, liabilities or expenses, SelfMaid shall not be held liable for the same. SelfMaid may from their end give this as a warning to the service professional.
    • We have undertaken the KYC to collect relevant information of the Service Professional and in case the customer wishes to conduct police verification of the Service Professional, you are requested to have the same at your end. It is also your responsibility to be careful regarding your belongings and be prudent with the safety and security of the same.
    • SelfMaid assures to provide a relevant document of the Service Professional. In case any Service professional have any criminal record then SelfMaid will not be held responsible.
    • You must treat Service Professionals courteously and lawfully, and ensure that the location in which they will be providing the Services is the safe and appropriate working environment for the Service Professional, in compliance with all applicable laws and regulations.
    • In case you do not like the Service Professional who has been assigned to you, kindly give a notice of 30 days before you release the Service Professional so that we can find a suitable replacement for you. Replacement policy regarding replacement of service professional are mentioned in the services section, Please refer that.
    • SelfMaid will provide replacement of Service Professional provided reasonable grounds are given for the same. SelfMaid will need appropriate time to find and allocate the Service Professional to your premises.
    • The Customer agrees that the Service Professional will not go through any harm, torture, harassment by you. In case any of the above takes place then the Company shall not be held responsible. If you make the worker do any illegal, unlawful or violative act then only the customer will be held liable for any such consequences.
    • The customer will be responsible for providing all the equipment and utensils required for cleaning and cooking and other work necessities.
    • Any online payment method will lead to a convenience fee (As per the Customer’s Bank). This fee has to be paid by the Customer.
    • We guide the Service Professionals regarding washing hands before and after service. They have been told to maintain no physical contact with the customers while providing services and we request to the customers for the same.
    • The company has recorded the details of the service professionals, which are mentioned in the Aarogya Setu Application.
    • It is the sole responsibility of the customers to update the company regarding their poor health. If a customer fails to do so and that leads to a positive case, the company takes no responsibility for such kind consequences.
    • The company has used all their best measures. This disease is out of anybody’s control and nobody can judge the intention or non-intention of the spreading. We can only assure the best of our precautions. In spite of all the precautions, if anyone gets infected, the company will not be held liable for the same.
    • At SelfMaid we take all possible steps, including the Covid-19 negative test report (Covid test is an optional service, a customer may or may not opt), to ensure that any Service Professional/ domestic worker/maid placed is healthy and free from COVID-19 inspection, however, due to the contagious nature of Coronavirus/COVID-19 any exposure, before or after placement may result from the actions, omissions, or negligence including, but not limited to, Service Professional/domestic worker/maid, and customer(s)/their family members. In any such case, if any maid/domestic worker is found to be exposed/ infected by COVID-19 after their placement, customer(s) shall provide a quarantine/isolation facility to their respective Service Professional/domestic worker/maid which is in line with the guidelines imposed by the public health authorities to stop the further spread.

      -SELFMAID'S SERVICES

      FULL TIME (24 HOURS SERVICE)

      It is an annual subscription service that allows our customers to discover and replace Service Professionals as per their convenience.

      Subscription:

      • The subscription for 24 hours service shall remain valid for a period of 1 year which commences from the date on which a customer confirms for the joining of the Service Professional.
      • Subscription amount shall not include monthly salary of the Service Professional(s). Customer shall be paying monthly salary directly to the maid(s). Subscription amount shall only include (a) Assignment of a suitable Service Professional and (b) Two Service Professional replacements.
      • The minimum period of subscription shall be 12 months.
      • The Subscription ends after 2 Service Professional replacements or when the term of the subscription expires, or when the subscription is cancelled.

      Trial:

      • The Company provides for two days trial to the customer in order to analyse the Service Professional and to experience the services rendered by the Service Professional.
      • The sole and exclusive purpose of the trial period shall be assessment of compatibility of the Service Professional according to the customer’s preferences.
      • The trial period in no case shall be free of cost. The salary for the trial period shall be payable by the customer which shall be calculated in accordance with pre-determined per day salary of the Service Professional(s).
      • After the expiry of the trial period, the customer shall communicate to Selfmaid, about the confirmation or rejection of the Service Professional(s). In case no communication regarding confirmation or rejection of the service professional(s) is made after the expiry of the said trial period, it shall be deemed that the customer has confirmed the appointment of the same service professional(s) which he/she has tried and shall be liable to pay the balance subscription amount.

      Payment:

      • INR 30,000/- (Inclusive of 5% GST) shall be the annual subscription fee. Subscription amount shall be payable upfront immediately after communication of confirmation or immediately on expiry of the above mentioned trial period.
      • In case a customer opts or intends to opt for two days trial period, an amount equivalent to 25% of the annual subscription fee i.e. INR 7500/- shall be deposited in advanced. This entire advanced deposit amount shall be adjusted in the total amount of the above-mentioned annual subscription fee in case the customer opts to obtain the subscription.
      • Only an amount of INR 5000/- shall be refundable in case the customer wishes to reject the subscription after the first trial of the Service Professional.
      • The refund process of money by SelfMaid will take a maximum period of 25 days except in special circumstances where it can be exceed.
      • All payments made by Customer’s in the form of “Credits” are non-interest bearing. Unutilized and unclaimed "Credits" for a period of more than 180 days from the date of purchase of "Credits" shall expire and stand forfeited. No refunds of credits will be processed after the expiry date.
      • An amount of INR 2500/- out of this advanced deposit shall be Non-refundable in any case.
      • No refund of any kind shall be made after the confirmation of the first Service Professional maid by the customer.
      • In case the customer directly hires service professional(s) introduced by Selfmaid, such customer shall be liable to pay the full amount of Rs. 30,000/- as damages or else Selfmaid reserves the right to recover this amount through appropriate legal proceedings.

      Replacements:

      • Customers obtaining the subscription can avail up to 2 Service Professional replacements during the active period of subscription. No replacements shall be provided after expiry of subscription.
      • There shall be in no case change in the Monthly salary of the replaced Service Professional (s). Any negotiations (pertaining to monthly salary of the Service Professional) made between customer and the Service Professional(s) shall be done in their personal capacity. Selfmaid Pvt. Ltd. shall not be subject to any of those negotiations.
      • No replacement will be provided to the customer in case the Service Professional leaves or quits or refuses to work with the customer due to ill behavior, refusal to pay or bad working conditions.
      • In a case, if any Service Professional, which has been confirmed by the customer (Please refer to point number 4 of Trial's Section), leaves, quits, or is terminated for any reason after the trial period. In that case, the company will provide the replacement, and henceforth in this way every replacement shall be counted.

      Other Inclusions:

      • Police registration of the assigned Service Professional(s) shall be done by the Company.
      • Any medical facilities, if necessary, provided by the Company to the Service Professional will only be given before the commencement of the subscription period and not throughout the period.
      • One time utility kit for the assigned Service Professional will be provided which includes A Uniform, Mask, Soap, Tooth Brush and a tooth paste etc. (The said utility kit/products shall be subject to availability only).


      The service shall be subject to the following conditions which a customer mandatorily needs to comply with:

      • The customer shall provide residence to the Service Professional in his/her own dwelling place, any place in vicinity of his/her house or any other place where the customer make use of the Service Professional’s service(s). Any cost pertaining to the residence, i.e. rent, electricity, water, maintenance charges, or any other charge/cost (not mentioned herewith), of the Service Professional shall in totality be borne by the customer. Such a residence shall consist of basic facilities like toilet, kitchen etc. and shall in no case be hazardous or near hazardous place/material.
      • The customer shall provide food and drinking water to the Service Professional. Such food and water shall maintain minimum standard of hygiene and quality which is fit for human consumption. Any cost pertaining to the basic food and water consumption of the Service Professional shall in totality be borne by the customer during the entire course of the Service Professional’s employment.
      • During the course of employment the customer shall arrange basic medical facilities for the Service Professional. In case of urgency the customer shall provide immediate medical assistance and (if required) shall arrange Service Professional’s transportation to a medical practitioner or medical institution.
      • The customer in no case can deprive any Service Professional of his/her fundamental rights. Any Service Professional, in no case, can be exploited or overburdened with work. The customer shall grant sufficient time for sleep, rest and other basic necessities.
      • There shall be two days of holidays every month for Service Professionals.

      PART TIME

      Part Time – 8/10/12 Hours

      It is an annual subscription service that allows our customers to discover and replace Service Professionals as per their convenience.

      Subscription:

      • The subscription for Part Time 8/10/12 Hours service shall remain valid for a period of 1 year which commences from the date on which a customer confirms for the joining of the Service Professional.
      • Subscription amount shall not include monthly salary of the Service Professional(s). Customer shall be paying monthly salary directly to the maid(s). Subscription amount shall only include (a) Assignment of a suitable Service Professional and (b) Four Service Professional replacements.
      • The minimum period of subscription shall be 12 months.
      • The Subscription ends after 4 Service Professional replacements or when the term of the subscription expires, or when the subscription is cancelled.

      Trial:

      • The Company provides for two days trial to the customer in order to analyse the Service Professional and to experience the services rendered by the Service Professional.
      • The sole and exclusive purpose of the trial period shall be assessment of compatibility of the Service Professional according to the customer’s preferences.
      • The trial period in no case shall be free of cost. The salary for the trial period shall be payable by the customer which shall be calculated in accordance with pre-determined per day salary of the Service Professional(s) (Calculated on the basis of 28 Days of working).
      • After the expiry of the trial period, the customer shall communicate to Selfmaid, about the confirmation or rejection of the Service Professional(s). In case no communication regarding confirmation or rejection of the service professional(s) is made after the expiry of the said trial period, it shall be deemed that the customer has confirmed the appointment of the same service professional(s) which he/she has tried and shall be liable to pay the balance subscription amount.

      Payment and Refund:

      • INR 15,000 + 5% GST shall be the annual subscription fee. Subscription amount shall be payable upfront immediately after communication of confirmation or immediately on expiry of the above mentioned trial period.
      • In case a customer opts or intends to opt for two days trial period, an amount equivalent to 33% of the annual subscription fee i.e. INR 5000 + 5% GST shall be deposited in advanced. This entire advanced deposit amount shall be adjusted in the total amount of the above-mentioned annual subscription fee in case the customer opts to obtain the subscription.
      • Only an amount of INR 2500/- shall be refundable in case the customer wishes to reject the subscription after the first trial of the Service Professional.
      • The refund process of money by SelfMaid will take a maximum period of 25 days except in special circumstances where it can be exceed.
      • All payments made by Customer’s in the form of “Credits” are non-interest bearing. Unutilized and unclaimed "Credits" for a period of more than 180 days from the date of purchase of "Credits" shall expire and stand forfeited. No refunds of credits will be processed after the expiry date.

      Replacements:

      • Customers obtaining the subscription can avail up to 4 Service Professional replacements during the active period of subscription. No replacements shall be provided after expiry of subscription.
      • There shall be in no case change in the Monthly salary of the replaced Service Professional (s). Any negotiations (pertaining to monthly salary of the Service Professional) made between customer and the Service Professional(s) shall be done in their personal capacity. Selfmaid Pvt. Ltd. shall not be subject to any of those negotiations.
      • No replacement will be provided to the customer in case the Service Professional leaves or quits or refuses to work with the customer due to ill behavior, refusal to pay or bad working conditions.
      • In a case, if any Service Professional, which has been confirmed by the customer (Please refer to point number 4 of Trial's Section), leaves, quits, or is terminated for any reason after the trial period. In that case, the company will provide the replacement, and henceforth in this way every replacement shall be counted.

      Other Inclusions:

      • Police registration of the assigned Service Professional(s) shall be an optional service for the customers *(Subscription Charges does not include Police Registration charges).
      • Any medical facilities, if necessary, provided by the Company to the Service Professional will only be given before the commencement of the subscription period and not throughout the period.
      • One time utility kit for the assigned Service Professional will be provided which includes A Uniform, Mask, a set of use and throw gloves *(The said utility kit/products shall be subject to availability only).

      The service shall be subject to the following conditions which a customer mandatorily needs to comply with:

      • The customer shall provide food and drinking water to the Service Professional. Such food and water shall maintain minimum standard of hygiene and quality which is fit for human consumption. Any cost pertaining to the basic food and water consumption of the Service Professional shall in totality be borne by the customer during the entire course of the Service Professional’s employment.
      • During the course of employment the customer shall arrange basic medical facilities for the Service Professional. In case of urgency the customer shall provide immediate medical assistance and (if required) shall arrange Service Professional’s transportation to a medical practitioner or medical institution.
      • The customer in no case can deprive any Service Professional of his/her fundamental rights. Any Service Professional, in no case, can be exploited or overburdened with work. The customer shall grant sufficient time for break and other basic necessities.
      • There shall be two days of holidays every month for Service Professionals.

      Part Time – Cleaning & Cooking

      It is an annual subscription service that allows our customers to discover and replace Service Professionals as per their convenience.

      Subscription:

      • The subscription for Part Time – Cleaning & Cooking service shall remain valid for a period of 1 year which commences from the date on which a customer confirms for the joining of the Service Professional.
      • Subscription amount shall not include monthly salary of the Service Professional(s). Customer shall be paying monthly salary directly to the maid(s). Subscription amount shall only include (a) Assignment of a suitable Service Professional and (b) Four Service Professional replacements.
      • The minimum period of subscription shall be 12 months.
      • The Subscription ends after 4 Service Professional replacements or when the term of the subscription expires, or when the subscription is cancelled.

      Trial:

      • The Company provides for two days trial to the customer in order to analyse the Service Professional and to experience the services rendered by the Service Professional.
      • The sole and exclusive purpose of the trial period shall be assessment of compatibility of the Service Professional according to the customer’s preferences.
      • The trial period in no case shall be free of cost. The salary for the trial period shall be payable by the customer which shall be calculated in accordance with pre-determined per day salary of the Service Professional(s) (Calculate on the basis of 28 Days of working).
      • After the expiry of the trial period, the customer shall communicate to Selfmaid, about the confirmation or rejection of the Service Professional(s). In case no communication regarding confirmation or rejection of the service professional(s) is made after the expiry of the said trial period, it shall be deemed that the customer has confirmed the appointment of the same service professional(s) which he/she has tried and shall be liable to pay the balance subscription amount.

      Payment:

      • INR 7,500 + 5% GST shall be the annual subscription fee. Subscription amount shall be payable upfront immediately after communication of confirmation or immediately on expiry of the above mentioned trial period.
      • In case a customer opts or intends to opt for two days trial period, an amount equivalent to 33% of the annual subscription fee i.e. INR 2500 + 5% GST shall be deposited in advanced. This entire advanced deposit amount shall be adjusted in the total amount of the above-mentioned annual subscription fee in case the customer opts to obtain the subscription.
      • This amount of INR 2500 + 5% GST shall be Non-refundable in any case.
      • No refund of any kind shall be made after full payment and confirmation of the first Service Professional by the customer.
      • In case the customer directly hires service professional(s) introduced by Selfmaid, such customer shall be liable to pay the full amount of Rs. 7,500/- as damages or else Selfmaid reserves the right to recover this amount through appropriate legal proceedings.

      Replacements:

      • Customers obtaining the subscription can avail up to 4 Service Professional replacements during the active period of subscription. No replacements shall be provided after the expiry of the subscription.
      • There shall be in no case change in the Monthly salary of the replaced Service Professional (s). Any negotiations (pertaining to monthly salary of the Service Professional) made between the customer and the Service Professional(s) shall be done in their personal capacity. Selfmaid Pvt. Ltd. shall not be subject to any of those negotiations.
      • No replacement will be provided to the customer in case the Service Professional leaves or quits or refuses to work with the customer due to ill behavior, refusal to pay, or bad working conditions.
      • In a case, if any Service Professional, which has been confirmed by the customer (Please refer to point number 4 of Trial's Section), leaves, quits, or is terminated for any reason after the trial period. In that case, the company will provide the replacement, and henceforth in this way every replacement shall be counted.

      Other Inclusions:

      • Police registration of the assigned Service Professional(s) shall be an optional service for the customers *(Subscription Charges does not include Police Registration charges).

In case of urgency the customer shall provide immediate medical assistance and (if required) shall arrange Service Professional’s transportation to a medical practitioner or medical institution.
      • The customer in no case can deprive any Service Professional of his/her fundamental rights. Any Service Professional, in no case, can be exploited or overburdened with work. The customer shall grant sufficient time for break and other basic necessities.
      • There shall be two days of holidays every month for Service Professionals.

      Modifications in Bookings

      In cases where Service Professional is absent due to medical reasons or a family emergency, a replacement will be given depending upon the availability. Also if the Company fails to provide replacement because of lack of availability then the accounts of the Customer shall be adjusted accordingly for future usage.

      Prohibitions with Respect To Services

      While using the Website, you shall not violate any laws, third-party rights, Account Policies, or any provision of the Terms and Conditions or circumvent our fee structure, the billing process, or fees owed to SelfMaid.

      Feedbacks

      As a user of the SelfMaid Platform, you agree to use careful, prudent, and good judgment when leaving Feedback for another user. If you violate any of the rules in connection with leaving Feedback, SelfMaid, in its sole discretion, may take any of the following actions: (i) cancel your Feedback or any of your Postings; and/or (ii) suspend your Account.

      In the event of any dispute between users of the Website concerning Feedback, SelfMaid shall be the final arbiter of such dispute.

      Feedbacks

      As a user of the SelfMaid Platform, you agree to use careful, prudent, and good judgment when leaving Feedback for another user. If you violate any of the rules in connection with leaving Feedback, SelfMaid, in its sole discretion, may take any of the following actions: (i) cancel your Feedback or any of your Postings; and/or (ii) suspend your Account.

      In the event of any dispute between users of the Website concerning Feedback, SelfMaid shall be the final arbiter of such dispute.

      Consent for Reaching Out Via Phone Call, SMS, Email or Any Other Form Of Electronic Communication

      You hereby agree that your registration with SelfMaid shall be deemed to be your consent to be contacted on (i) the mobile number shared by you even if you have opted out of receiving promotional calls and messages and (ii) by way of SMS or email notifications or messages in any other electronic form.

      PRIVACY POLICY

      SelfMaid has established a Privacy Policy that explains to users how their information is collected and used. The Privacy Policy is referenced above and hereby incorporated into the Terms and Conditions set forth herein. Your use of the SelfMaid Platform is governed by the Privacy Policy.

      USE OF SUBMITTED CONTENT

      SelfMaid may allow the hosting, sharing, and/or publishing of any communications submitted by you, including without limitation, your Profile, any Feedback, and all other Submitted Content. You understand that SelfMaid does not guarantee any confidentiality with respect to any Submitted Content. You agree that SelfMaid shall be free to use or disseminate such freely searchable Submitted Content on an unrestricted basis for the purpose of providing the Services. Any communications, comments, suggestions, or related materials sent to SelfMaid, (collectively, "Suggestions"), recommending changes to the Platform, shall be treated as non-confidential.

      MODIFICATIONS TO OR TERMINATION

      Modification Or Cessation

      SelfMaid reserves the right, from time to time, to modify or discontinue, temporarily or permanently, the SelfMaid Platform (or any part thereof) with or without notice and in its sole discretion. You agree that SelfMaid shall not be liable to you or to any third party for any modification, suspension or discontinuance of SelfMaid services.

      Termination by the Company

      You hereby acknowledge and agree that SelfMaid, in its sole and absolute discretion, has the right to deactivate your Account or otherwise terminate your access to or participation in the use of the SelfMaid Platform (or any part thereof), without notice, for any reason or if SelfMaid believes that you have violated any provision of the Terms and Conditions. You may cancel your contract with the SelfMaid Platform, with or without any prior intimation to SelfMaidby accessing the "Deactivate Account" on the SelfMaid Platform. You acknowledge and agree that SelfMaid shall not be liable to you or any third party for any termination of your Account.

      Termination by the User

      You may cancel your use of the website and/or terminate the Terms of Use with or without cause at any time by letting us know about any kind of deactivation. The Company will consider your account as deactivated account if your account is not operated for another 180 days.

      INTELLECTUAL PROPERTY RIGHTS

      SelfMaid Owns Or Holds The Licenses To All Data And Marks On The Website

      The content on the SelfMaid Platform and the trademarks, service marks and logos contained therein ("Marks"), are owned by SelfMaid. Other trademarks, names and logos on this Website are the property of their respective owners. Data on the Website is provided to you AS IS for your information and personal use only and may not be used, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purposes whatsoever without the prior written consent of the respective owners.

      SelfMaid's License To You For The Use Of Data And Marks

      The Website contains SelfMaid's Data and Marks, which are, or may become, protected by copyright, trademark, patent, trade secret and other laws, and SelfMaid owns and retains all rights in the SelfMaid Data and Marks. Subject to these Terms and Conditions, SelfMaid hereby grants you a limited, revocable, non-transferable license to reproduce and display the SelfMaid Data solely for your personal use in connection with accessing and participating in the Website.

      INDEMNIFICATION

      You agree to indemnify and hold us and (as applicable) our parent, service professionals, contractors, managers, successors, subsidiaries, affiliates, officers, directors, agents, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms and Conditions, your violation of any law, or your violation of the rights of a third party, including the infringement by you of any intellectual property or other rights of any person or entity.

      TAXES

      You understand that SelfMaid is acting solely as an intermediary for the collection of rents and fees between a Service User and a Service Professional who choose to enter into an Agreement for Service. Because state and local tax laws vary significantly, you understand and agree that you are solely responsible for determining your own tax requirements. Also, Payments made by the Customer’s are inclusive of 5% GST. You do not need to pay any extra fee apart from the monthly rental. No hidden charges, Brokerage from You.

      DISPUTE RESOLUTION

      You and SelfMaid hereby agree that any claim or controversy at law and equity that arises out of the Terms and Conditions or the SelfMaid Platform will be resolved to vide resolution processes when the customer writes to us at via e-mail at suppport@SelfMaidpvtltd.com. The dispute shall be resolved through alternative dispute resolution procedures, such as mediation or arbitration, as alternatives to litigation. The Terms of Use shall be governed in all respects by the laws of India and any legal proceeding arising out of this Agreement will occur exclusively in the courts located in New Delhi, India.

      LIMITATIONS OF LIABILITY

      SelfMaid, managers, agents, contractors, employees etc. shall not, in any case, be liable to you for any direct, indirect, incidental, special, punitive, consequential or exemplary damages (including but not limited to loss of business, revenue, profits, use, data or other economic advantages) whatsoever resulting from any access to or use of the website, any unauthorized use of your personal information, mistakes or errors of data, interruption through viruses by the third party, defamatory or illegal conduct of the third party. You further acknowledge and agree that SelfMaid shall not be liable for any direct, indirect, incidental, special, punitive, consequential or exemplary damages (including but not limited to loss of business, revenue, profits, use, data or other economic advantages) whatsoever resulting from or relating to any contract between website users entered into independently of the website.

      UNFORESEEABLE CIRCUMSTANCES

      The Company here removes liability for natural and unavoidable catastrophes that interrupt the expected course of events and restrict participants from fulfilling obligations. Neither SelfMaid nor you shall be liable to the other for any delay or failure in performance under the Terms and Conditions, other than payment obligations, arising out of a cause beyond its control and without its fault or negligence. These unavoidable and natural catastrophes may include but are not limited to fires, floods, earthquakes, strikes, unavailability of necessary utilities, blackouts, acts of God, acts of declared or undeclared war, acts of regulatory agencies, or national disasters.

      GENERAL INFORMATION

      • Third-Party Beneficiaries: You hereby agree that there shall be no third-party beneficiaries to the Terms of Use, except as otherwise expressly provided in the Terms of Use.
      • Notice: You agree that SelfMaid may provide you with notices, including those regarding changes to the Terms and Conditions, by email, regular mail, or postings on the SelfMaid Platform.
      • Entire Terms and Conditions: The Terms and Conditions, together with the Privacy Policy and any other Additional Policies, shall constitute the entire agreement between you and SelfMaid. If any of these Terms and Conditions are determined by a competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law. These Terms and conditions are governed by Indian law.
      • Statute Of Limitations: You agree that any cause of action arising out of or related to the Website must commence within one (1) year after the cause of action accrues. Otherwise, such cause of action is permanently barred.
